By booking a tour or charter with Cancun Catamaranes, you ("Guest") agree to these Terms and Conditions. Please read them carefully.

1. Bookings and Payment

• A booking is confirmed upon receipt of a deposit or full payment as specified in your quote
• Prices are quoted in US Dollars (USD) and are subject to change before confirmation
• Dock fees (approximately $18 USD/person) are not included in charter prices and are paid at the marina on the day of the tour
• Crew gratuity is not included and is at the Guest's discretion (10–15% suggested)

2. Health and Safety

• All guests must follow crew instructions at all times while on board
• Life vests and safety briefings are provided for all guests
• Guests with medical conditions that may be aggravated by boat travel or snorkeling are advised to consult their physician before booking
• We reserve the right to refuse boarding to guests who appear intoxicated or who pose a safety risk to themselves or others
• Children under 6 years old may snorkel only with parental supervision and at the captain's discretion
• Non-swimmers must notify the crew prior to departure. Life vests are provided and mandatory for non-swimmers in the water

3. Charter and Tour Conditions

• Private charters are exclusive to the booking party only
• The captain and crew have full authority over all decisions related to navigation, safety, and itinerary while at sea
• If sea conditions, weather, or port authority decisions require a change of itinerary, the captain will make the safest decision. No refund is due for itinerary modifications made for safety reasons while the tour is in progress
• The vessel may not be used for any illegal activity
• Guests are responsible for any damage to the vessel or equipment caused by negligence or misconduct

4. What Is Included

Unless otherwise specified in your booking confirmation, private charters include: exclusive use of the vessel, open bar (beer, spirits, mixers, water, soft drinks), snorkeling equipment for all guests, bilingual captain and crew, and music system. See specific tour pages for detailed inclusions.

5. What Is Not Included

Dock fees, crew gratuity, hotel transportation, meals, personal underwater cameras, wetsuit rental, travel insurance, and any third-party services arranged by the guest are not included unless explicitly stated in your booking confirmation.

6. Port Authority Compliance

All tours operate under the authority and regulations of the Port Captain of Cancun (Capitanía de Puerto). If the Port Authority closes the port for any reason, tours will be cancelled or rescheduled per our Cancellation Policy.

7. Liability Limitation

Cancun Catamaranes and its crew exercise reasonable care for the safety and enjoyment of all guests. However, we are not liable for personal injury, illness, lost or damaged personal property, or any losses resulting from events beyond our control (weather, port closures, acts of nature, government regulations). Guests participate in water activities at their own risk.

8. Photography and Marketing

We may take photos during tours for marketing and social media purposes. If you prefer not to be photographed, please inform your captain before departure. We will respect your preference.

9. Governing Law

These Terms are governed by the laws of Mexico. Any disputes shall be resolved under Mexican law in the jurisdiction of Cancún, Quintana Roo.
